1. Accepting These Terms
Welcome to Calwyn. These Terms of Service ("Terms") are a legally binding agreement between you and Shivam Singh, an individual doing business as "Calwyn" ("Calwyn," "we," "us," or "our"), governing your access to and use of the Calwyn platform and related services at calwyn.app (the "Service").
By creating an account, checking the box to accept these Terms, or otherwise using the Service, you agree to these Terms in full. If you do not agree, do not use the Service.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.
2. Eligibility
To use Calwyn, you must:
- Be at least 18 years old (or the age of majority in your jurisdiction, if higher);
- Have the legal capacity to enter into a binding contract;
- Not be prohibited from using the Service under applicable law; and
- Not have had a prior account terminated by Calwyn for cause.
By using the Service, you represent and warrant that you meet all of these requirements. The Service is not directed at or intended for use by anyone under 18.
3. Your Account
Registration. To access the Service, you must create an account. Account creation and authentication are handled through our identity provider, Clerk. You agree to provide accurate, current, and complete information when registering and to keep it up to date.
Security. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. If you suspect unauthorized access, contact us immediately at hello@calwyn.app.
One account per person. You may not create multiple accounts to circumvent Free-tier limits or for any other reason. Each account is for a single individual's personal use.
4. The Service — What Calwyn Provides
Calwyn is an AI-assisted career-tools platform that helps individual job seekers prepare, optimize, and track their job applications. The Service currently includes:
- Résumé Tailoring — adapting your résumé to match a specific job description using AI;
- Cover Letter Generation — drafting personalized cover letters for target roles;
- Outreach Drafting — generating professional outreach messages (e.g., LinkedIn notes, cold emails);
- Interview Preparation — practice questions and structured preparation materials (including STAR-method coaching and multiple-choice practice exams);
- Salary Negotiation — negotiation talking points and guidance; and
- Application Tracker — a personal dashboard to manage and track your job applications.
The Service is for personal, individual job-seeking purposes only. It is not a career-counseling service, and nothing in the Service constitutes professional career advice, legal advice on employment matters, or a guarantee of any employment outcome.
We may change, add, or remove features at any time. We will provide reasonable notice of material changes that affect paid subscribers.
5. AI Features — Important Disclaimers
Please read this section carefully. It covers the nature and limitations of all AI-powered features in Calwyn.
5.1 AI is a Tool, Not an Advisor
Calwyn uses third-party AI services to power its features. All AI-generated outputs — including tailored résumés, cover letters, outreach messages, interview questions, and negotiation scripts — are suggestions produced by software. They are not reviewed by a human career professional before being presented to you.
You are always the final decision-maker. Calwyn's AI features assist you; they do not advise you.
5.2 Accuracy is Not Guaranteed
AI outputs may be:
- Inaccurate — the AI may misinterpret a job description, produce factually incorrect claims, or fail to reflect the nuances of your background;
- Incomplete — outputs may omit information relevant to your specific situation;
- Not optimal — what the AI suggests may not be the best approach for your circumstances, industry, or target employer; or
- Outdated — the AI's knowledge has a training cutoff and may not reflect current market conditions or hiring norms.
5.3 You Must Review All Outputs
Before submitting, sending, or relying on any AI-generated content, you must review it carefully. You are responsible for ensuring that:
- All factual claims in your résumé or cover letter accurately reflect your real experience and qualifications;
- Outreach messages are appropriate for your context and relationship with the recipient;
- Interview-preparation materials are relevant to the specific role you are targeting; and
- Any negotiation talking points reflect your actual situation and risk tolerance.
Do not submit AI-generated content verbatim without review. Misrepresenting your credentials in a job application can have serious professional and legal consequences, for which Calwyn bears no responsibility.
5.4 No Guarantee of Employment Outcomes
Using Calwyn — including any AI feature — does not guarantee:
- That you will receive an interview, job offer, callback, or any response from an employer;
- That your application will perform better in any applicant tracking system (ATS) or human review;
- Any salary increase, negotiation success, or improved compensation; or
- Any other career outcome whatsoever.
Calwyn is a tool. The outcomes of your job search depend on many factors outside Calwyn's control, including employer decisions, market conditions, and your own qualifications.
5.5 Not a Substitute for Professional Advice
AI outputs are not a substitute for advice from a qualified career counselor, employment attorney, HR professional, or any other expert. If you need professional guidance on employment law, discrimination, contract review, or other specialized matters, please consult a licensed professional.
6. Subscription Plans, Billing, and Payments
6.1 Plans
Calwyn offers the following plans:
- Free Plan — available to all registered users at no cost. Includes up to 5 AI-tailored applications per calendar month (reset at UTC midnight on the first of each month). No credit card is required. Calwyn does not offer a free trial of the Pro Plan; there is no trial period that converts to a paid subscription.
- Pro Plan — a paid subscription that provides higher usage allowances and access to all features. Pro is available on weekly, monthly, and quarterly billing cycles at the rates shown on our pricing page at calwyn.app/pricing. Current pricing is always shown at the time of purchase.
6.2 Payments and Merchant of Record
Payments for Pro are processed by Polar (polar.sh), which acts as the Merchant of Record and seller of record for all paid transactions on Calwyn. When you subscribe to Pro, you are entering into a purchase transaction with Polar. Your subscription charges will appear on your payment statement as "Polar" — not "Calwyn."
Polar collects and remits all applicable sales tax, VAT, and GST on your behalf. Calwyn does not separately collect sales tax on subscriptions.
For billing inquiries — such as questions about a charge, a failed payment, or invoice requests — contact us at hello@calwyn.app and we will coordinate with Polar to resolve your issue. Polar handles payment processing, not product support.
6.3 Auto-Renewal
Your Pro subscription renews automatically at the end of each billing period (weekly, monthly, or quarterly, depending on the plan you selected) at the then-current price, unless you cancel before the renewal date. By subscribing, you authorize recurring charges to your payment method on file until you cancel.
California residents: Pursuant to California's Automatic Renewal Law (Cal. Bus. & Prof. Code §§ 17600–17606), the material terms are: (a) the subscription automatically renews at the end of each billing period; (b) the charge is the price shown at checkout for your selected plan (weekly, monthly, or quarterly), billed each period; (c) you may cancel at any time via your account settings at calwyn.app/settings; and (d) cancellation instructions are provided in §7.
6.4 Price Changes
If we change the price of a Pro subscription, we will give you at least 30 days' notice before the new price takes effect, via email and/or an in-app notification. Continued use after the price change takes effect constitutes acceptance of the new price. If you do not agree, cancel before the renewal date on which the new price would apply.
6.5 Payment Failures
If your payment method is declined or otherwise fails, your subscription may be suspended or downgraded to the Free Plan until payment is successfully processed. You are responsible for keeping your payment information current.
7. Cancellation
You may cancel your Pro subscription at any time via Account Settings → Billing at calwyn.app/settings. You must cancel through the in-app cancellation flow.
What happens when you cancel:
- Your subscription will not renew at the end of the current billing period.
- You keep full Pro access through the end of the period you have already paid for.
- At the end of that period, your account automatically reverts to the Free Plan. Your data is retained.
- Cancellation does not delete your account. To delete your account and data, use the account-deletion feature in Settings.
There is no cancellation fee.
8. Refunds
Cancellation does not automatically entitle you to a refund for any portion of a current or past billing period.
Refund eligibility window:

Refund requests submitted within the applicable window, where service use during the period has been limited, may be honored. Because Polar is our Merchant of Record, all refunds are processed through Polar and the final refund determination is Polar's. Under Polar's policy, fees for elapsed billing periods are non-refundable except where required by law or where the service was not provided; the windows above apply within the current billing period, before substantial use.
To request a refund, email hello@calwyn.app with your account email address and a brief reason. We will respond within 5 business days.
Renewals are non-refundable. Refund eligibility applies to new billing periods only, not to subscription renewals.
9. Your Content — Ownership and License
9.1 You Own Your Content
You retain full ownership of all content you create, upload, input, or generate using the Service — including your résumés, cover letters, outreach messages, interview notes, job-application data, and any AI-generated outputs produced for you ("Your Content").
Calwyn does not claim ownership of Your Content.
9.2 License You Grant to Calwyn
To operate the Service, you grant Calwyn a limited, non-exclusive, non-transferable, royalty-free license to store, process, display, and use Your Content solely to provide the Service to you. This license ends when you delete your content or close your account (subject to any legal retention obligations described in §14).
This license does not permit Calwyn to sell, disclose, or use Your Content for purposes unrelated to your use of the Service.
9.3 No AI Training on Your Personal Career Content
Calwyn does not use your identifiable personal career content — including your résumés, cover letters, job-application details, or other personal information you provide — to train AI models.
We may analyze aggregated, de-identified usage patterns (e.g., which feature types are most commonly used, how outputs are typically revised) to improve our products. This analysis does not include your personal content in identifiable form.
This commitment is a core part of how we earn your trust.
9.4 Feedback
If you submit suggestions, bug reports, feature requests, or other feedback, you agree that Calwyn may use it freely without obligation, attribution, or compensation. Feedback is not Your Content for the purposes of §9.1–9.3.
9.5 Content Responsibility
You are solely responsible for Your Content. You represent that you have the rights to submit all content you upload, that it does not violate any third-party rights, and that all factual claims in your résumés and application materials accurately represent your real experience and qualifications.
10. Acceptable Use
Calwyn is designed for individual job seekers. To keep the platform fair and effective for everyone, you agree not to:
Commercial misuse:
- Use Calwyn to create résumés, cover letters, or career content for other people for payment or any commercial purpose, including operating a résumé-writing service, career-coaching business, or similar offering.
Technical abuse:
- Access the Service through automated means (scripts, bots, scrapers, or crawlers);
- Attempt to extract, reproduce, or reverse-engineer Calwyn's AI prompts, scoring systems, or proprietary methodologies;
- Circumvent, disable, or interfere with any security feature of the Service;
- Create multiple accounts to exceed Free-tier limits or otherwise circumvent usage restrictions; or
- Attempt to gain unauthorized access to any part of the Service or its infrastructure.
Harmful or illegal use:
- Use the Service to create content that is defamatory, fraudulent, threatening, harassing, or discriminatory;
- Submit false, misleading, or fabricated credentials or work history to Calwyn's AI features in order to generate misleading application materials;
- Violate any applicable local, national, or international law or regulation; or
- Use the Service in any way that could harm Calwyn, its users, or third parties.
Violating this section may result in immediate account suspension or termination.
11. Calwyn's Intellectual Property
The Calwyn platform — including its software, design, code, AI feature implementations, brand, trademarks, logos, and all other proprietary systems and content — is owned exclusively by Calwyn and protected by intellectual property laws. These Terms do not grant you any rights to Calwyn's intellectual property except the limited right to use the Service as described here.
You may not copy, modify, reverse-engineer, decompile, disassemble, or create derivative works from any part of the Calwyn platform.
12. Disclaimers of Warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CALWYN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
CALWYN DOES NOT WARRANT THAT:
- THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR HARMFUL COMPONENTS;
- THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE, COMPLETE, OR RELIABLE; OR
- ANY ERRORS IN THE SERVICE WILL BE CORRECTED.
Some jurisdictions do not allow certain disclaimer language; in those cases, the above may not apply to you, and you may have additional rights.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
CALWYN'S TOTAL CUMULATIVE LIABILITY to you for any claims arising out of or relating to these Terms or the Service will not exceed the greater of: (A) the total fees you paid to Calwyn in the 12 months preceding the claim, or (B) USD $100.
IN NO EVENT WILL CALWYN BE LIABLE to you for any indirect, consequential, incidental, special, punitive, or exemplary damages — including but not limited to lost profits, lost data, lost career opportunities, business interruption, or reputational harm — even if Calwyn has been advised of the possibility of such damages, and regardless of the theory of liability.
Some jurisdictions do not allow the exclusion of certain damages or the limitation of liability; in those cases, Calwyn's liability will be limited to the maximum extent permitted.
14. Termination
14.1 Termination by You
You may close your account at any time via Settings → Account → Delete Account. Deletion is permanent. We strongly recommend you export your data (Settings → Export) first. If you have an active Pro subscription, cancel it before deleting to avoid further charges.
14.2 Termination by Calwyn
We may suspend or terminate your account, with or without notice, if:
- You breach these Terms;
- We detect fraudulent activity, abuse of the Free tier, or manipulation of metering;
- You initiate a fraudulent or abusive chargeback with your payment provider;
- Required by law or regulation; or
- At our discretion, for any other reason.
We will provide notice where reasonably practicable, except where immediate action is required for security, legal compliance, or fraud prevention.
14.3 Effect of Termination
Upon termination:
- Your right to access the Service ends immediately (or at the end of your current billing period for voluntary cancellation).
- Your content is scheduled for permanent deletion within 30 days, giving you a window to contact us if termination was in error.
- Billing records and information we are required to retain by law may be kept longer.
- Sections 9.4, 11, 12, 13, 15, and 17 survive termination.
15. Dispute Resolution and Governing Law
Governing law. These Terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of India, without regard to conflict-of-law principles.
Informal resolution first. Before starting any formal dispute, please email hello@calwyn.app describing the issue, so we can try to resolve it in good faith. If we cannot resolve it within 60 days of your written notice, either party may pursue the remedies below.
Arbitration. Any dispute not resolved informally will be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, before a single arbitrator. The seat and venue of arbitration is Bengaluru, Karnataka, India. The arbitration will be conducted in English and may be held remotely.
Courts. Subject to the arbitration provision above, the courts at Bengaluru, Karnataka, India have exclusive jurisdiction over any matter arising out of or relating to these Terms or the Service.
California residents. Regardless of the governing-law choice above, California's consumer-protection laws — including the Automatic Renewal Law (Cal. Bus. & Prof. Code §§ 17600–17606) and the California Consumer Privacy Act (CCPA) — apply to California residents, and nothing in these Terms waives rights that California law grants you as a consumer. These Terms are designed to comply with those requirements.
16. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the "Last Updated" date at the top of this page;
- Notify you via email (to the address on file) and/or an in-app notification at least 14 days before the changes take effect; and
- For paid subscribers, provide at least 30 days' notice before changes that materially affect your subscription rights.
Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree, stop using the Service and cancel any active subscription before the effective date.
17. Miscellaneous
Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Calwyn regarding the Service and supersede all prior agreements.
Severability. If any provision of these Terms is found invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.
No Waiver. Calwyn's failure to enforce any provision is not a waiver of its right to enforce that provision in the future.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign our rights and obligations freely, including in connection with a merger, acquisition, or sale of assets.
Force Majeure. Calwyn is not liable for any failure or delay caused by circumstances beyond our reasonable control, including natural disasters, power failures, internet outages, or government actions.
Language. These Terms are written in English. To the extent any translated version conflicts with the English version, the English version controls.
Export Compliance. You represent that you are not located in a country subject to a government embargo applicable to you, and that you are not on any prohibited-party list. You agree to comply with all applicable export-control laws.
